Financial Matters on Divorce
Acted for Wife in financial proceedings on divorce. Matter involved assets of just under £2 million pounds. The Husband had periods instructing solicitors and other periods as acting in person. Assets included a valuable property in India. There was also a question of a third-party interest being that of the Husband’s brother, which involved him being invited to intervene in the proceedings. There were also Capital Gains Tax issues that had to be taken into account. Ultimately the matter settled on the first day of the final hearing with a favourable outcome for the client.
Acted in a complex private law children matter involving two parents who were the biological parents to one child and also joint special guardians for two other children. Matter included making an urgent application to the Court after the youngest daughter made disclosures indicating possible sexual abuse. There was subsequently also an allegation of assault from one of the other children against the other party. The police, social services and CAFCASS were all involved for the purpose of carrying out investigations. Given the acrimonious relationship between the parties and allegations of parental alienation, a Guardian was appointed for the children. Towards the end of the case a 3-day final hearing was listed but a way forward was agreed by way of a consent order on the first day of the hearing.
