Post-termination restrictions or ‘restrictive covenants’, if drafted correctly, can provide vital protection for businesses in respect of their confidential information and trade secrets, customer and client details and the stability of the workforce. They can be an important tool to protect businesses against the potential harm that can be caused by departing employees who may attempt to use information gained and connections made whilst in employment, in a rival business.

As a result of Covid-19, the government has now undertaken a public consultation on the use on non-compete clauses, the purpose of which is to seek views on proposals to make non-compete clauses enforceable only when the employer provides compensation during the term of the clause.

Join Victoria Regan, Partner, in the Employment Team at Rix & Kay and Adam Ohringer, Barrister, of Cloisters Chambers who will provide an update on the current options available to employers who may need to enforce restrictive covenants. Attendees will also hear from Joe Fitzsimons, Senior Policy Advisor at IoD who will provide an update on the recent government consultation on non-compete clauses and what the future might hold.

About the speakers

Victoria Regan is a Partner in Rix & Kay’s employment team. She provides strategic and operational employment law advice to businesses throughout the region.

Adam Ohringer is a Barrister at Cloisters Chambers and leading employment specialist. Adam is regularly involved in employment-related litigation in the High Court representing Claimants and Defendants in high value claims for breach of contract or restrictive covenants.

Joe Fitzsimons is Senior Policy Advisor at IoD. In addition to Education and Skills and Future of the Workforce, Joe leads the IoD’s Sustainability and Diversity and Inclusion policy work.
