Redundancy issues are a reality for many businesses. The law surrounding the redundancy is complex and strict.

The Rix & Kay Employment Team can assist you by :-

  • Advising you strategically & looking at your Business Case
  • Ensuring that you carry out a fair procedure during the process;
  • Assisting, advising or managing the consultation process;
  • Identifying any selection pools & advising on selection criteria
  • Managing the Redundancy Consultation Meetings
  • Drafting settlement agreements;
  • Advising on business transfers (TUPE Transfers);
  • Dealing with any Unfair Dismissal claims
  • Contract Variation issues
  • Voluntary Redundancy

Redundancy is a potentially fair reason for dismissal. It is however, essential that employers carry out a fair redundancy procedure, or the dismissal may be deemed unfair even if there are genuine grounds for making employees redundant. This includes the need to carry out consultation with those affected including employees and their trade union representatives.

Statutory Redundancy Payments

Certain employees will be entitled to Statutory Redundancy Pay (SRP) in the event they are made redundant. In order to be eligible for SRP, employees must have two years’ of continuous employment by the expiry of their notice period. SRP is calculated using the employee’s employment start date and termination date, their age and weekly earnings before tax (gross pay). Find out more information on the UK Government SRP rates.

Remember that in addition to SRP, employees may also be entitled to any accrued but outstanding holiday, unpaid wages and/or notice pay.
