Contentious trusts and wills expertise
We have particular expertise in dealing with claims under the Inheritance (Provision for Family and Dependants) Act 1975 where we can advise on the financial provision that you may be entitled to receive from an estate where you consider that your share is insufficient or not in accordance with the deceased’s intentions. These claims can be made by children, spouses / partners and beneficiaries of the estate.
We also act on contested Will disputes where there may have been problems with the construction of the Will, such as incorrect witnessing, or fraud. We also deal with cases where there are allegations of duress and undue influence on the testator.
We can provide you with advice and representation on Court of Protection proceedings and disputes relating to attorneys, who were appointed either under an Enduring Power of Attorney (EPA) or a Lasting Power of Attorney (LPA).
We have expertise in dealing with cases where there were allegations of misapplication of funds by an attorney and an application was made by executors for an account to be taken. We also have experience in Statutory Will proceedings.
Clients of Rix & Kay find the service provided by the contentious trust and probate practice to be ‘thoroughly professional, sympathetic, never overbearing, and knowledgeable; the response time is normally 24 hours, if not quicker, and the advice is always helpful and not intimidating.’ Alan Foster is ‘a very experienced contentious probate solicitor who provides sound, practical advice focusing on the needs of the client’. He leads a team with a strong track record acting for high-net-worth individuals in contentious probate matters involving high-value estates, some with assets exceeding £15m in value.
