Contentious Probate

Building on our established reputation in Probate and Estate Administration and Wills, Estate Planning and Trusts, Rix & Kay has developed an expertise in resolving disputes between family members and executors and beneficiaries of estates.

Contentious trusts and wills expertise

We have particular expertise in dealing with claims under the Inheritance (Provision for Family and Dependants) Act 1975 where we can advise on the financial provision that you may be entitled to receive from an estate where you consider that your share is insufficient or not in accordance with the deceased’s intentions. These claims can be made by children, spouses / partners and beneficiaries of the estate.

We also act on contested Will disputes where there may have been problems with the construction of the Will, such as incorrect witnessing, or fraud. We also deal with cases where there are allegations of duress and undue influence on the testator.

We can provide you with advice and representation on Court of Protection proceedings and disputes relating to attorneys, who were appointed either under an Enduring Power of Attorney (EPA) or a Lasting Power of Attorney (LPA).

We have expertise in dealing with cases where there were allegations of misapplication of funds by an attorney and an application was made by executors for an account to be taken. We also have experience in Statutory Will proceedings.
