When acting for sellers it is important that our property lawyers are brought in at an early stage in order to assemble the property related disclosed documents and to review them and identify any potential problems. Often potential issues that are identifiable at this stage can be resolved thus reducing the prospect of the buyer seeking seller indemnities and/or enhanced warranties. When acting for buyers it is important that the scope of property due diligence is agreed by the buyer and the property solicitors at an early stage. Full property due diligence can take a long time and can be expensive especially where a large number of properties are to be acquired. It may therefore be prudent to identify only the key properties on which full due diligence process is required.
