On 10 December 2020 the Ministry of Housing, Communities & Local Government published a new ‘How to Rent – the checklist for renting in England’ guide. The Landlord must, in any post 01 October 2015 AST tenancy or renewal tenancy, provide the Tenant with a copy of the ‘How to Rent’ guide and it must be the most recent version available at the start of the tenancy. A hardcopy of the guide must be provided unless the tenant consented to receive a PDF version via email. Failure to serve the guide, or the correct version, renders a Landlord unable to serve a Section 21.
