As a result of the most recent lockdown situation the Government has introduced new legislation to protect tenants from eviction for a further period of time. The Public Health (Coronavirus) (Protection from Eviction and Taking Control of Goods) (England) Regulations 2020 came into force on 17 November 2020 (England only) and will remain in force until 11 January 2021.

There are some exceptions to the Regulation, these are set out in Regulation 2. These include, trespassers and anti-social behaviour as well a ‘substantial rent arrears’ exception which is defined as at least 9 months arrears at the date on which the possession order was made, although this cannot include rent arrears accrued after 23 March 2020 being ‘Covid-19 arrears’.
