Already suffering from emotional and physical trauma following serious sexual assault (and in one case rape) by licensed black cab driver John Worboys, the victims have now learned that they are not entitled to any compensation under motor insurance policies used by licensed taxis. The high-profile case of Worboys, who sexually assaulted at least 12 women (police believe there are other victims who have not come forward), has been well publicised in the media. Ten of the victims embarked on a landmark action to claim damages from the insurers, London based inceptum insurance, however Lord Justice Silber ruled that the bodily injuries suffered by the victims did not arise out of Worboys use of the vehicle as covered by his insurance policy. If successful this would have enabled victims of similar attacks to hold the insurers of taxi drivers responsible and large compensation payouts could become a regular thing, as it could encompass all public service vehicles, and even privately owned vehicles.
